Welcome to abani. These Terms of Service (the “Terms”) govern the use of the website https://abani.mx (the “Site”) and the purchase of our natural personal care products. Please read them carefully before making a purchase.
1. Identification of the owner
The Site is operated by abani (hereinafter “abani”, “we”), with its address at Dalias 6133, Bugambilias, Puebla de Zaragoza, Puebla, Mexico. For any question, clarification or complaint you may write to us at hola@abani.mx.
abani operates exclusively within the United Mexican States, and its operations are governed by applicable Mexican law.
2. Acceptance of the Terms
By browsing the Site, creating an account or making a purchase, you expressly accept these Terms, as well as our Privacy Notice. If you do not agree with them, we ask you to refrain from using the Site.
3. Legal capacity
To purchase on the Site you must be of legal age (18 years or older) and have the legal capacity to contract under Mexican law. When you place an order, you declare that the information you provide is truthful, accurate and up to date.
4. Products
abani offers naturally sourced personal care products, mainly solid bars (such as solid shampoo and conditioner), formulated without parabens or sulfates, free of plastic and not tested on animals.
- The photographs, descriptions and ingredients of the products are informative in nature and seek to represent them as faithfully as possible. There may be minor variations in color, scent or presentation inherent to natural and artisanal products.
- The ingredient list is published on each product. If you have known allergies or sensitivity to any component, review the formula before purchasing and stop using it if any reaction occurs.
- The information on the Site does not constitute medical or dermatological advice and is not a substitute for consulting a health professional. If you have questions about your skin or hair, consult a specialist.
- Product availability is subject to stock. We reserve the right to modify or discontinue products at any time.
5. Prices, currency and taxes
- All prices are expressed in Mexican pesos (MXN) and include Value Added Tax (IVA), unless otherwise stated.
- Shipping costs are calculated and shown before you confirm your order.
- We reserve the right to modify prices at any time; the applicable price will be the one in force at the time you confirm your purchase.
- If an incorrect price is published due to an obvious error, we will notify you before processing the order and you may confirm or cancel the purchase at no cost.
6. Purchase process
- Select the products and add them to the cart.
- Provide your contact details and shipping address.
- Make the payment through the enabled platform.
- You will receive an order confirmation by email.
The order confirmation constitutes the completion of the sale. We reserve the right not to accept or to cancel an order in cases of unavailability of stock, price error, suspected fraud or breach of these Terms, in which case we will refund any amount paid.
7. Payments
Payments are processed securely through our provider Stripe. abani does not store or have access to the full details of your card or bank account; that information is handled directly by Stripe in accordance with its own policies and with the security standards of the payment industry. By paying, you accept the terms and conditions of the payment processor.
8. Shipping and delivery
- We ship anywhere in the Mexican Republic. We do not ship internationally.
- Estimated delivery times are 3 to 10 working days from payment confirmation, and may vary depending on the carrier, the destination zone and factors outside abani’s control (weather conditions, contingencies, etc.).
- Shipping costs may vary by destination; they are calculated and shown before you confirm your order.
- It is the customer’s responsibility to provide a correct and complete delivery address. abani is not responsible for delays or failed deliveries arising from incorrect details or from the absence of a person to receive the order.
- Once the package has been delivered to the address provided, responsibility for the product passes to the customer.
9. Exchanges, returns and warranties
Your rights as a consumer are protected by the Federal Consumer Protection Law (LFPC) and other regulations applicable to electronic commerce in Mexico (including NOM-247-SE-2021).
- Timely notice. If you detect a problem with your order, you must notify us within 3 business days of receipt, at hola@abani.mx, attaching your order number and photographic evidence.
- Grounds for replacement or refund. Given the nature of personal care products, and for reasons of hygiene and safety, we do not cover exchanges or returns of opened or used products. A replacement or refund will only proceed where there is an obvious manufacturing defect or where you were delivered a product different from the one ordered, and always provided the product is unused and in its complete original packaging. Outside these grounds we cannot cover defects or returns.
- Refunds. Applicable refunds will be made through the same payment method used, within a reasonable period once the request has been validated.
Nothing in this section limits the non-waivable rights that the LFPC grants you as a consumer.
10. User account
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity carried out under your account. Notify us immediately of any unauthorized use. Account and order management relies on the infrastructure provider Supabase, as stated in our Privacy Notice.
11. Intellectual property
All content on the Site, including the “abani” brand, the logo, texts, photographs, designs, formulas and graphic elements, is the property of abani or is used under license, and is protected by Mexican intellectual and industrial property law. Its reproduction, distribution or use without prior written authorization is prohibited.
12. Permitted use of the Site
You undertake to use the Site lawfully and not to: (i) carry out fraudulent activities or activities that compromise the security of the Site; (ii) use automated systems to extract information; (iii) impersonate third parties; or (iv) interfere with the operation of the Site. Breach may lead to the cancellation of your account and to the exercise of any corresponding legal actions.
13. Limitation of liability
abani will not be liable for indirect or incidental damages arising from the use of or inability to use the Site, nor for failures attributable to third parties (payment providers, carriers, hosting services or internet outages). Our liability is limited, in any case, to the value of the corresponding order, without prejudice to the rights the law grants to consumers.
14. Protection of personal data
The processing of your personal data is governed by our Privacy Notice, prepared in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties in force in Mexico. We recommend that you consult it.
15. Modifications to the Terms
We may modify these Terms at any time. The version in force will always be the one published on the Site, with its update date. Continued use of the Site after a modification implies acceptance of the Terms in force.
16. Applicable law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For their interpretation and performance, in consumer matters the consumer may turn to the Federal Consumer Protection Agency (PROFECO). In the event of a dispute not resolved by that route, the parties submit to the jurisdiction of the competent courts of Puebla, Puebla, waiving any other jurisdiction that might correspond to them by reason of present or future domicile.
